1. The service
Fikacare is a hospital information system provided by Fikazon. It consists of the application installed on the hospital's machines, the cloud services that back it up, deliver updates and provide the owner's portal, and the support described in the hospital's plan.
2. The hospital's account and devices
The hospital is responsible for the staff accounts it creates, the roles it assigns and the devices it enrols. A device that is lost or leaves the hospital should be retired from the portal promptly so that it can no longer hold hospital data.
3. Plans and payment
Plans are billed monthly or yearly in advance at the prices on the pricing page or in the hospital's agreement. If a payment fails we retry and send reminders. After a 21-day grace period the cloud services pause: the portal shows only billing and data export, and cloud sync and new device approvals stop. The machines in the hospital keep working and keep syncing with each other, and the hub's lease continues to be renewed for a further 60 days. Service resumes immediately on payment.
4. The hospital's data
The hospital owns its data. Fikazon processes it only to provide the service, under the data processing agreement and the privacy policy. The hospital can export all of its data at any time and for 90 days after the agreement ends, after which we delete it and issue a deletion certificate.
5. Clinical responsibility
Fikacare records and organises the hospital's work. Clinical decisions remain the responsibility of the hospital and its clinicians. The system does not replace professional judgement, and the hospital should keep whatever paper backup its regulator requires.
6. Availability and updates
The application is designed to keep working when the internet, the power or a machine fails, and the cloud services are designed to be available continuously, but we do not promise that either will be uninterrupted. Updates are signed, released in stages and can be declined by the hospital's administrator, except for security fixes.
7. Acceptable use
The hospital agrees not to use the service to store data it has no right to hold, to attempt to defeat its security, or to resell it. Fikazon may suspend an account that is being used to attack the service, after telling the hospital.
8. Ending the agreement
Either side may end the agreement at the end of a billing period by giving notice. Section 4 describes what happens to the data.
9. Liability
Fikazon's liability under these terms is limited to the fees the hospital paid in the twelve months before the claim, except where the law does not allow a limit. The full agreement each hospital signs sets this out in detail.
10. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria.
